Waiver of Liability and Hold Harmless
Agreement
The Net Result respects the
integrity and operation of your computer systems and will conduct all
business transactions accordingly. As such, the following statements apply
to all services provided by The Net Result, or its assigns:

Privacy of information. All data, processes, or
procedures are considered by The Net Result to be private and
confidential. The Net Result, or its assigns, will endeavor to safeguard
this confidentiality by all appropriate and reasonable means.
Information will be accessed solely when required to perform specific
tasks regarding the maintenance or repair of the client’s systems.
Knowledge of any system, procedure, or process, whether or not
proprietary in nature, will not be shared or divulged without the
express knowledge and consent of the customer. However, The Net Result
accepts no liability for any such disclosure by any of its employees,
even if such disclosure is a result of accident or negligence.

Hardware and Software. The Net Result will act in
such a manner as to not cause any damage to any hardware or software
owned by the customer. However, should any damage occur, the only
liability of The Net Result is the replacement of any damaged hardware
or software with a suitable part or item in terms of condition and
quality. The Net Result will accept no other liability, or
responsibility for loss of use, loss of productivity, loss of income, or
any other losses, direct or indirect, resulting from such damage, even
if such damage is a result of accident or negligence.

Integrity of Data. It is the sole responsibility
of the customer to make a backup of any important data that they wish to
retain. While all reasonable precautions will be taken to safeguard and
prevent the loss of data, there is no guarantee that any data associated
with the computer will remain intact. This includes files, folders, or
programs installed on the computer or media left in any drives. The Net
Result strongly urges the customer to have and maintain current,
verifiable backups of all critical data and can assist the customer in
this task when requested. Should any loss of data occur, The Net Result
accepts no liability for loss of data, or loss of business, income, or
time resulting from any such data loss, even if such a loss is a result
of accident or negligence.
The customer
understands and accepts that The Net Result maintains a general business
liability policy which will cover damage to property or personal injury.
The customer further understands and accepts that such insurance does not
provide protection for professional errors and omissions, data loss, or
accidental disclosure of proprietary or confidential information. The
customer, in evidence of such, will review their own insurance coverage
and act accordingly.
The customer hereby
AGREES TO INDEMNIFY AND HOLD HARMLESS The Net Result, and its assigns,
from any loss, liability, damage or costs, including court costs and
attorney fees, that they may incur due to any actions by The Net Result,
and its assigns, WHETHER CAUSED BY NEGLIGENCE or otherwise.
By engaging The Net Result for services,
the customer ACKNOWLEDGES AND REPRESENTS THAT they have read the foregoing
Waiver of Liability and Hold Harmless Agreement and understand it.
Furthermore, the customer understands that no oral representations,
statements, or inducements, apart from the foregoing written agreement,
have been made.
